From the recently released trove of Clinton documents (p. 104) comes this memo from Elena Kagan to White House Counsel Jack Quinn, in which she apologizes for not telling him about a media appearance on Crossfire. Kagan admits she “really fucked up” and said, “God, do I feel like an idiot.” Without knowing more about the context, kudos to Kagan for accepting responsibility for her missteps. This is a rare trait in Washington, where people are often too quick to pass the buck.
Also in Kagan-related documents, via Victoria Kwan, we see that Justice Kagan advised against seeking an extension from the Supreme Court in the Jones v. Clinton litigation. She wrote that it “may appear devious, unseemly, even desperate” to request more time from the Court. Also this may help the justices form “preconceptions” about the case.
