4th Circuit Denies Stay in SSM Case, Marriages to Begin on Aug. 20 Unless SCOTUS Intervenes

The 4th Circuit declined to stay its ruling, so unless the Supreme Court gets involved before Aug 20, same-sex marriages will begin in the Old Dominion State. Judge Niemeyer dissented, and would have voted to grant the motion.

So, I’m sure we will have another frantic petition before the Court. But unlike in Utah, the Attorney General will not be filing it. One of the clerks, presumably with standing, will file the appeal. Stay tuned.

Update: I note that the court’s order didn’t even deign to mention the Supreme Court’s stay in a virtually identical case from Utah.
