What’s to stop Democrats from changing rules to stop SCOTUS Filibusters?

November 21st, 2013

If a vacancy at One First Street should arise, I don’t see what stops the majority party from revising the rule to stop a filibuster of a Supreme Court nomination. There’s no need to do this now because there are no vacancies. But if a seat opens up–perhaps before the Dems lose the Senate in 2014–I can see another nuclear option. Also, this moves seems to be a tacit acknowledgment that the Republicans will take the Senate in 2014, and the Dems will work overtime to fill vacancies before that.
