The Madigan decision from the 7th Circuit, which was denied rehearing en banc in February, is on its way up. The petition will likely be filed in May, and a response shortly thereafter. Depending on the timing, it may even come up at the long conference before the start of the term. That is the case to watch. If anything else, the Court can wait for the current gun-legislation drama to play out in the Congress. Granting cert on the New York case today would’ve created an unnecessary buzz, as the Court winds its way towards a blockbuster conclusion. Let’s revisit this issue in October.
