Jonathan Mitchell Gets a (Laughter) at his first Supreme Court Argument

Jonathan Mitchell, the current Solicitor General of Texas, and my former Professor at GMU had (what I think is) his first Supreme Court Argument in Gonzales v. Thaler, and he got a (laughter)!

Mr. Mitchell: I see my time has expired.

CHIEF JUSTICE ROBERTS: Do you want to finish your sentence?

MR. MITCHELL: We ask the Court to vacate and remand, or in the alternative, affirm.

Thank you.

CHIEF JUSTICE ROBERTS: That’s a different sentence.

(Laughter.)

Now Justice Kagan called Mitchell General, and everyone else called him Mr. Mitchell. What’s the protocol?
