“Arizona is suing the federal government, again.”

August 25th, 2011

What is it with Arizona? They seem to have more Supreme Court cases than any other state. Anyway, Rick Hasen thinks this case may be the case for the Court to strike down Section 5 of the Voting Rights Act, something they came short of doing in NAUMDO v. Holder. From the complaint:

The State of Arizona, through undersigned counsel, brings this civil action for declaratory judgment that §§ 4 and 5 of the Voting Rights Act of 1965, as amended in 2006 (the “VRA” or the “Act”) are unconstitutional and seeks injunctive relief preventing enforcement of these sections of the Act

Update: From the WSJ Lede: “What is it with Arizona and the federal government? Arizona seems constantly to be on a collision course of late with federal authorities or federal law.” As usual, you heard it here first.
