In the orders, the Court denied certiorari on the North Carolina Ultrasound Case. With three words, and no opinion, “Justice Scalia dissents.”
A colleague noticed this similar odd notation from the orders two weeks ago, where Justice Sotomayor dissented from another case.
Is this a new pattern? I don’t recall seeing this before. Usually, a Justice “would grant” certiorari. The use of the word “dissent” is odd here.
