On Thursday, February 19, the John Marshall Law School Federalist Society Chapter hosted me for what was supposed to be a discussion of executive power, but quickly morphed into an analysis of Judge Hanen’s decision in Texas v. United States. My interlocutor was Professor Steven Schwinn, whose work I’ve followed for years on the Constitutional Law Profs Blog. We had a wide-ranging discussion focusing on standing (Article III and prudential), the APA, and the Take Care Clause.
