In this lecture during our first class session, Judge Gibson and I discuss the origins of the least dangerous branch. We cover Article III, Federalist Nos. 78-83, Brutus XI, XII, and XV, and Marbury v. Madison. We begin by asking what is the “judicial power”? My recitation of Mabury is summed up as, “Dude, where’s my job?” Some excellent discussions.
