In class last week, I taught both my constitutional law class, and advanced constitutional law seminar about the Take Care Clause. We had a fascinating discussion, where I probe as the devil’s advocate the pros and cons of Texas’s suit against DAPA. (I filed a brief in their support, but identify a few weaknesses of the case).
