Other than the Courts, who has considered the constitutionality of the Affordable Care Act?

Secretary Sebelius:

When the U.S. Supreme Court takes up the Affordable Care Act later this month, it will not be the first to consider its constitutionality.

Congress carefully weighed its authority in writing the law.

Speaker Pelosi on whether the Mandate is Constitutional:

“Are you kidding? Are you kidding?”

I am not convinced by the argument that Congress considers whether a bill is constitutional (I’m not sure if it really matteres). I seems that the winning party merely attempt to pass laws that advances its agenda, and the side that loses argues that the law exceeds Congress’s power.
